Terms of Use
Last updated: June 2026
1. Acceptance of Terms
These Terms of Use (‘Terms’) constitute a legally binding agreement between you (‘User’, ‘you’) and Ogle Property Technology Limited, a company incorporated in Nigeria (‘Ogle’, ‘we’, ‘us’). By registering an account on our Platform or by using any part of the Platform, including our website at https://ogle.ng, you agree to be bound by these Terms in full. If you do not accept these Terms, please do not use the Platform.
These Terms should be read together with our Privacy Policy and Cookie Policy, all of which are incorporated herein by reference. In the event of any conflict between these Terms and those policies on a matter of data protection, the Privacy Policy shall prevail.
We reserve the right to amend these Terms at any time. Where we make material changes, we will notify registered users by email or by a prominent notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after that date constitutes your acceptance of the amended Terms.
2. The Platform
The Ogle Platform is an online marketplace that facilitates the discovery, listing, booking, renting, leasing, buying, and selling of land and real property in Nigeria. Ogle acts as an intermediary platform connecting buyers, sellers, landlords, and tenants. We are not a party to any transaction between those users unless expressly stated otherwise in a specific service agreement.
Ogle does not hold, transfer, or guarantee title to any property listed on the Platform. All transactions are entered into directly between the relevant parties. You are strongly advised to conduct your own independent due diligence — including verification of title, land use rights, and encumbrances — and to seek independent legal and financial advice before entering into any property transaction.
Nothing on the Platform constitutes professional legal, financial, estate agency, or valuation advice of any kind.
3. Eligibility
To register an account and use the full features of the Platform, you must be at least 18 years of age and have the legal capacity to enter into binding contracts under the laws of the Federal Republic of Nigeria. By registering, you represent and warrant that you meet these requirements.
The Platform is available only to individuals and entities that can lawfully use it under applicable Nigerian law. We reserve the right to refuse registration to, or terminate the account of, any person or entity at our sole discretion.
4. Zero Tolerance for Objectionable Content and Abusive Behaviour
Ogle has a zero-tolerance policy for objectionable content and abusive users. By creating an account or using Ogle, you agree that you will not create, upload, post, publish, transmit, or share any content, or engage in any conduct, that is:
- unlawful, fraudulent, deceptive, or misleading;
- harassing, threatening, bullying, hateful, or discriminatory (including on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or nationality);
- obscene, pornographic, sexually explicit, violent, or otherwise offensive;
- defamatory, abusive, or an invasion of another person’s privacy; or
- spam, a scam, or otherwise intended to deceive, exploit, or harm other users.
You are solely responsible for the content you submit and for your interactions with other users.
We reserve the right, at our sole discretion and without prior notice, to review, moderate, remove, or disable access to any content, and to suspend or permanently terminate any account, where we determine that this policy has been or may be violated.
Reporting and blocking: You can report objectionable content and block abusive users at any time from within the app using the in-app ‘Report’ and ‘Block user’ controls. We review all reports and will remove objectionable content and eject the responsible user within 24 hours of becoming aware of a violation.
By using Ogle, you acknowledge and agree to this policy.
5. User Accounts
To access certain features of the Platform, you must register an account. When doing so, you agree to the following obligations:
- Provide accurate, current, and complete information during registration, and keep your account information up to date at all times.
- Maintain the confidentiality of your username and password, and never share your login credentials with any third party.
- Accept responsibility for activities occurring under your account, except where such activity is the direct result of a security breach, technical vulnerability, or operational failure originating from the Platform or Ogle’s failure to maintain appropriate security measures in accordance with its statutory duties under the NDPA 2023. Notify us immediately at fraud@ogle.ng if you suspect unauthorised access to your account.
We reserve the right to immediately suspend or restrict access to any account found to be in breach of these Terms, or where we possess reasonable grounds to suspect fraudulent, abusive, or unlawful activity. Permanent termination of an account based on suspected infractions will only occur following a comprehensive internal review by our compliance team. Affected users will be provided with written notice of the suspension and a reasonable opportunity to submit a counter-notice or evidence to dispute the findings before a final termination decision is executed.
6. User Obligations
By using the Platform, you represent, warrant, and undertake that:
- All information you provide to Ogle or to other users through the Platform is accurate, truthful, and not misleading.
- You will comply with all applicable Nigerian laws and regulations, including those relating to real property transactions, consumer protection, anti-money laundering, and data protection.
- You will use the Platform only for its intended purpose and in accordance with these Terms and our Acceptable Use Policy.
- Where you list a property, you have the legal right to do so, and all information provided in the listing is accurate and complete.
- You will not engage in any conduct that disrupts or damages the Platform or adversely affects the experience of other users.
7. Intellectual Property
All intellectual property rights in the Platform — including its design, software, databases, content, trademarks, service marks, and logos — are owned by or licensed to Ogle. You are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform solely for its intended purpose in accordance with these Terms.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any part of the Platform, or commercially exploit any content from the Platform, without our prior written consent.
User-generated content — such as property listings, photographs, reviews, and messages — remains your property. By posting such content, you grant Ogle a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, adapt, publish, and display that content for the purposes of operating and promoting the Platform. You represent and warrant that you have all necessary rights to grant this licence and that your content does not infringe the rights of any third party.
Any suggestions, ideas, or recommendations you submit to us regarding the Platform may be used by Ogle at our discretion. We do not commit to compensate you for any such submissions.
8. Property Listings and Transactions
Users who list properties are solely responsible for the accuracy, completeness, and legality of their listings. This includes ensuring they have the legal right to list the property, that the description and photographs are accurate and not misleading, and that the listing does not violate any applicable law or third-party right.
Ogle reserves the right to remove any listing that we reasonably believe is fraudulent, inaccurate, in breach of these Terms, or otherwise harmful to users or to the integrity of the Platform. We may do so without prior notice and without liability to the lister.
Any agreement entered into between a buyer and a seller, or between a landlord and a tenant, through the Platform is a direct agreement between those parties. Ogle is not a party to that agreement. Users are advised to satisfy themselves as to the identity of the other party and the terms of the transaction before proceeding.
9. Fees and Payments
Where Ogle charges fees for certain features or services, those fees will be clearly disclosed before you commit to a transaction. All fees are stated in Nigerian Naira unless otherwise specified and are inclusive of any applicable taxes.
Payments made through the Platform are processed by our designated third-party payment processors. By making a payment, you agree to the payment processor’s terms and conditions. Ogle is not responsible for errors or failures attributable to the payment processor.
Refund and cancellation terms for specific services will be set out at the point of transaction. In the absence of a specific refund policy, our general position is that booking deposits are non-refundable unless otherwise stated.
10. Disclaimers and Limitation of Liability
The Platform is provided on an ‘as is’ and ‘as available’ basis. To the fullest extent permitted by Nigerian law, Ogle excludes all warranties, representations, and conditions — whether express, implied, statutory, or otherwise — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
Ogle makes no warranty that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected.
Ogle shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of, or inability to use, the Platform — including loss of profits, data, goodwill, or business interruption — even if advised of the possibility of such damages.
Our total aggregate liability to you in connection with these Terms, whether in contract, tort, or otherwise, shall not exceed the total fees paid by you to Ogle in the twelve months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes Ogle’s liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot lawfully be excluded or limited under Nigerian law.
11. Third-Party Links and Services
The Platform may contain links to websites or services operated by third parties. These links are provided for your convenience only and do not constitute an endorsement by Ogle. We have no control over, and accept no responsibility for, the content, privacy practices, or terms of any third-party website or service. You access such websites entirely at your own risk.
12. Suspension and Termination
You may close your account at any time. Upon closure, your access to account-specific features will cease immediately.
Ogle reserves the right to suspend or terminate your account at any time, with or without notice, if we determine that you have breached these Terms, our Acceptable Use Policy, or any applicable law, or if your account is associated with fraudulent or abusive activity.
Termination does not affect any rights or obligations that have accrued prior to termination, including payment obligations and any licence granted by you in respect of content posted to the Platform.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days, initiated by written notice to the other party.
Nothing in this clause limits or restricts a consumer’s statutory right to lodge a formal complaint or seek administrative redress before the Federal Competition and Consumer Protection Commission (FCCPC) or any other authorised regulatory tribunal in Nigeria. Where negotiation fails and administrative remedies are exhausted, the courts of Lagos State, Nigeria, shall have jurisdiction. If the dispute is not resolved within the 30-day negotiation period, either party may then pursue formal proceedings.
14. General
- Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
- Entire Agreement: These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Ogle with respect to the Platform and supersede all prior agreements, representations, and understandings.
- Waiver: No failure or delay by Ogle in exercising any right under these Terms shall constitute a waiver of that right.
